Terms
All prices are F.O.B. Long Beach or Tulare , California depending upon point of origin. All new accounts are Cash, COD, Credit Card (Visa or Master Card only) or C.I.A. until credit is established. We cannot make a determination on any credit application submitted for approval unless made at least two (2) weeks before shipment. Open accounts are due on the 10th of the following month following shipment. Past due accounts are subject to service charge on all unpaid balance at the legal maximum rate of interest. There are no warranties which extend beyond the description herein. There will be a $25.00 charge on all returned checks. In the event it becomes necessary for Orange County Nursery, Inc. to file suit to enforce payment of past due accounts, such suit may be brought in Los Angeles, Orange, San Diego or Tulare counties, California at the seller's option and Orange County Nursery, Inc. shall be entitled to collect fees, actual attorney fees, court costs and interest at the legal maximum rate on all amounts found to be due and payable.
California Improvement Assessment
By state law, a 1% charge will be made on all pome, stone and nut trees, grapevines and flowering trees. This money is for research on improved detection, testing or budwood and seed tree sources, and treatments to produce virus-free selections on all varieties. The goal is to produce a healthier tree for the commercial growers and homeowner.
Delivery/Minimum Order
California - Minimal delivery charge within California . Minimum order for delivery - $1,000.00.
Out-of-state - Out-of-state shipments are made by common carrier at the going rate. Minimum order for out-of-state delivery - $1,500.00.
Customer Pick-up - Minimum order - $500.00
Packing
Certain varieties can be specially packed when sent on common carrier or U.P.S. Please inquire as to which varieties pertain. A 15% packing and handling charge will be assessed. $2,500 minimum order required.
Claims
Claims for errors, shortages or damages must be made in writing to our office within 3 days (72 hours) of delivery.
Conditions
No orders consisting of less than full bundles will be accepted. We reserve the right to reduce the quantity to be delivered or to substitute a smaller or larger grade.
Non-Warranty
Orange County Nursery, Inc. exercises the utmost care to keep all varieties true to name. However, each sale is made subject to the condition that should any plant material sold by it prove to be otherwise, Orange County Nursery, Inc.'s liability will be limited to the sum actually received by it for such material, and in no event shall it be held liable for any greater amount. Any cancellation made by customer will affect the discount if made to go into a lower discount category. Pricing will be based on amount of original acknowledgment before initial delivery. Discounts will be applied only if all balances are paid when due and all other charges are current. (*Quantity and prepayment discounts do not apply to royalties and picture labels)

Delivery
There is a minimum delivery chare out of the local F.O.B. Long Beach, CA. Most out-of-state shipments are made by common carrier at the going rate. We deliver anywhere with a minimum of lead-time, full or combination loads. Please call for delivery rates and minimum order requirements. It should be noted that when coordinating the delivery of a large quantity of specimen trees, several days in advance notice should be allowed for the collecting and loading of trees for delivery. In addition, certain size trees may create a wide load and special permits must be obtained in order to transport these loads. The unloading of the trees at their final destination is the responsibility of the customer, with the assistance of the driver of the delivery vehicle. The customer should make arrangements to have available any necessary equipment to off-load the trees.
Customer Pick-Up
Customer pick-up is a welcome way for clients to save on delivery charges. Please notify us at least 48 hours in advance so that we may effectively assemble your order.
Minimum Orders
Delivery within California : $1,000.00
Out-of-State Delivery: $1,500.00
Customer Pick-Up: $500.00
Restocking Charge
Orange County Nursery, Inc. emphasizes accurate representation of plant specifications and delivery date to our customers. In the event plant material is canceled upon delivery and cancellation is not related to the condition of the plant material, Orange County Nursery, Inc. will charge a restocking fee to cover costs of assembly, loading, delivery and restocking.
Stand-By Time
Due to increased costs, Orange County Nursery, Inc. will charge for waiting time on job site deliveries as follows: 1st hour, no charge; 2nd hour or fraction thereof, $50.00 per hour.
Preliminary Lien Notice & Material Release
For the benefit of the Contractor and Orange County Nursery, Inc., we will request information as to developer/owner, general contractor, and lender on all job sites prior to delivery on all charge accounts. Preliminary lien notice will be issued and mailed within 20 days of the shipment. A material release will be issued upon complete payment of account. Please make necessary arrangements prior to shipment.
Claims
Orange County Nursery, Inc. guarantees all plate material to be delivered in good condition. Adjustment claims must be made within 3 days of receipt of merchandise. Such claims must be in writing. Once accepted in good condition, OCN cannot be responsible for improper handling, planting, maintenance or damage by the elements. Orange County Nursery, Inc.'s guarantee is limited to the cost of plant material supplied by it.

Hold Orders
Orders for future delivery may be held up to 30 days. Any orders held longer will require a substantial deposit or a monthly maintenance charge, or both, depending on arrangements made at the time of the sale.
